1. Overview
OpenMail ("we", "us", or "our") provides an AI-powered email marketing platform (the "Service") that allows you to create, send and analyze email campaigns. By creating an account or using the Service, you agree to these Terms of Service.
2. Eligibility & Accounts
You must be at least 18 years old to use OpenMail. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Acceptable Use
You agree that you will not use OpenMail to:
- Send unsolicited bulk email (spam) or violate any anti-spam laws (such as CAN-SPAM, GDPR, or local regulations).
- Send content that is illegal, harmful, misleading, or infringes on the rights of others.
- Use purchased, rented, or scraped email lists without proper consent.
We reserve the right to suspend or terminate accounts that violate these rules or Paddle's Acceptable Use Policy.
4. Subscriptions & Billing
OpenMail is offered as a subscription service. Payments, taxes, and invoices are processed securely by our payment partner Paddle, who acts as the Merchant of Record. By subscribing, you agree to Paddle's Terms and your chosen plan's pricing and billing frequency.
5. Trials & Cancellation
If your plan includes a free trial, you can cancel at any time before the trial ends to avoid being charged. You can manage or cancel your subscription from within the OpenMail app or via the Paddle customer portal.
6. Data & Privacy
We process personal data on your behalf in order to provide the Service. Our use of data is described in our Privacy Policy. You are responsible for obtaining any necessary consent from your own contacts and complying with applicable data protection laws.
7. Service Availability & Changes
We aim to keep OpenMail available 24/7 but do not guarantee uninterrupted service. We may modify or discontinue parts of the Service, and will make reasonable efforts to notify you of major changes.
8. Limitation of Liability
To the maximum extent permitted by law, OpenMail shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of revenue, data, or business opportunities.
